Early Intervention Policy

Section 1 - Object and Scope

Object

(1) In accordance with the provisions of the National Code of the Education Services for Overseas Students Act 2000 (the ESOS Act) which came into effect on 1 July 2007, Charles Sturt University (the University) is required to have an early intervention strategy in place for international (on shore) students who fail 50% of their subjects in a given study period (this has been clarified as being a compulsory semester or session). The Act also requires that where a student fails to meet the 50% requirement in two successive compulsory semesters, they must be considered for reporting to the Department of Immigration and Citizenship (DIAC). Reporting a student to DIAC has the potential effect of cancelling their Visa, but this does not mean that they will be excluded from their course unless the relevant University Academic Policies have been breached.

(2) In establishing an early intervention strategy in accordance with the ESOS Act, the University has approved that a similar intervention process also apply to domestic students, with the exception of the procedures pertaining to visas.

Scope

(3) This Policy applies to all onshore international and domestic students of Charles Sturt University, studying in all modes.

(4) This Policy does not replace the obligation on the University to report to DIAC any international students who may come to the attention of the University, at any time, for other breaches of international student visa requirements, such as non-enrolment or failure of all subjects.

Section 2 - Early Intervention Policy

Onshore International Students

(5) Onshore international students who fail fifty-percent or more of their subject points in a compulsory period of study (currently Autumn and Spring sessions) will be notified by ebox message of the following:

  1. that they should discuss their academic performance with their Course Director or Course Coordinator
  2. that they should access the student support services that are available to them through the Division of Student Services
  3. that their access to an International Student Visa may be reviewed if their academic performance does not improve.

(6) In the event that an onshore international student fails to pass 50% of their subjects for a second or further consecutive period, they will be notified in writing and via the ebox of the following:

  1. that they should discuss their academic performance with their Course Director or Course Coordinator
  2. that they should access the student support services that are available to them through the Division of Student Services
  3. that they should refer to the University's Academic Progress Policy;
  4. that their International Student Visa will be subject to a compulsory review and of arrangements for the review process.

Compulsory Review of an International Student Visa

(7) A review of an International Student Visa will be conducted by a Committee.

(8) The Committee shall take advice from:

  1. lecturers about the student's attendance and engagement (eg. Assessable tasks or discussion about options for change of course);
  2. the Division of Student Services about whether the student has sought access to support services available to them (but not the detail of those services) to assist their academic performance; and
  3. any other information that may assist in making the decision whether or not to report the student to DIAC.

(9) Should the Committee decide to report an international student to DIAC, then the usual requirements for notification and appeal against the decision will apply.

Section 3 - Early Intervention Procedures

(10) The Division of Student Administration is responsible for the administration of the Early Intervention Policy. Enquiries about Early Intervention procedures should be referred to the Division of Student Administration.
